These Terms and Conditions govern your use of the website www.distinctiveportraits.net and all photography services provided by Distinctive Portraits, owned and operated by Mark Hearndon. By accessing our website, booking a session, or using our services, you agree to be bound by these Terms and Conditions.

1. Services Offered

Distinctive Portraits provides professional photography services including, but not limited to:

• Professional headshots

• On-site headshot services for businesses and corporations

• High school senior graduate portraits

• Family, model, fashion, and event photography

Specific services, pricing, deliverables, and timelines are outlined at the time of booking and may vary by session type.

2. Booking and Payment

• A signed agreement and/or payment may be required to secure your session date.

• Session fees are due as stated at booking and are non-refundable unless otherwise specified in writing.

• Payment methods accepted will be communicated at the time of booking.

• Prices are subject to change without notice; confirmed bookings will honor the agreed-upon rate.

 

3. Cancellations and Rescheduling

• Clients must provide at least 48 hours’ notice to reschedule a session.

• Cancellations made with less than 48 hours’ notice may result in forfeiture of the session fee.

• In the event of illness, weather issues, or circumstances beyond our control, Distinctive Portraits reserves the right to reschedule without penalty.

 

4. On-Site Corporate Headshot Sessions

• The client is responsible for providing adequate space, access, and coordination of participants.

• Delays caused by late or unprepared participants may reduce the number of final images delivered.

• Overtime or additional services may incur extra charges.

 

5. Image Delivery and Turnaround

• Image delivery timelines vary by service and will be communicated during booking.

• Final images are delivered digitally unless otherwise agreed.

• Unedited or RAW images are not provided.

 

6. Copyright and Usage Rights

• All photographs remain the copyrighted property of Distinctive Portraits.

• Clients receive a non-transferable license to use images for personal or business purposes as agreed at booking.

• Commercial use beyond the agreed scope requires written permission.

• Images may not be altered, sold, or submitted to third parties without consent.

 

7. Model Release and Marketing Use

Unless otherwise requested in writing, clients grant Distinctive Portraits permission to use images for:

• Portfolio and website display

• Social media and marketing materials

• Studio samples and promotional use

Clients may opt out of marketing usage by submitting a written request prior to the session.

 

8. Client Responsibilities

• Clients are responsible for personal appearance, wardrobe, and grooming.

• Distinctive Portraits is not responsible for dissatisfaction related to styling choices made by the client.

• It is the client’s responsibility to review images promptly and report any concerns within 7 days of delivery.

 

9. Limitation of Liability

Distinctive Portraits is not liable for:

• Acts beyond our control including equipment failure, weather conditions, or third-party disruptions

• Loss or damage to personal property during sessions

• Indirect, incidental, or consequential damages

In any event, liability shall not exceed the amount paid for the photography services.

 

10. Website Use

• Content on this website is for informational purposes only.

• You may not copy, reproduce, or distribute website content without written permission.

• Unauthorized use of this website may give rise to a claim for damages.

 

11. Privacy

Your use of this website is also governed by our Privacy Policy. Information submitted through the website is used solely for communication and service delivery purposes.

 

12. Governing Law

These Terms and Conditions are governed by the laws of the State of Michigan, without regard to conflict of law principles.
